Art. 1.—(1) Any person who improperly reproduces with gainful intent, by whatever process, the graphic composition of literary, dramatic, scientific, educational and musical works or parts thereof that are protected by Law No. 633 of April 22, 1941, as subsequently amended, or who, without having taken part in the reproduction but being aware of it, places such reproductions on the market or stocks them with a view to sale in the territory of the State, or for profitmaking purposes brings them into the territory of the State, shall be liable to an administrative fine of 1,000,000 to 3,000,000 lire, and in particularly serious cases to a fine of up to 10,000,000 lire.

(2) Neither the use of reproductions of musical scores for an educational, study or research activity, including exercises and gatherings associated with amateur musical activities and activities engaged in by nonprofit associations and foundations, nor the use for other public events of musical scores that cannot be purchased on the market shall be regarded as being for profitmaking purposes.

Art. 2.—(1) Amounts deriving from the application of the pecuniary sanctions provided for in Article 1 above and in Laws Nos. 406 of July 29, 1981, and 400 of July 20, 1985, shall be paid to the National Assistance and Provident Association for Painters and Sculptors, Musicians, Writers and Playwrights.

Art. 3.—(1) Articles 177, 178 and 179 and the last paragraph of Article 172 of the aforementioned Law No. 633 of April 22, 1941, are repealed.

(2) Articles 52, 53, 54, 55 and 56 of the Regulations for the Application of Law No. 633 of April 22, 1941, on the Protection of Copyright and Other Rights Associated with the Exercise Thereof, approved by Royal Decree No. 1369 of May 18, 1942, are repealed.

This Law, bearing the seal of the State, shall be included in the official collection of normative instruments of the Italian Republic. All persons are bound to observe it and cause it to be observed as a law of the State.

Dispositions en matière de reproduction abusive de livres et abrogation

de la contribution sur les œuvres de notoriété publique visées aux articles 177, 178 et 179

et au dernier alinéa de l’article 172 de la loi n o 633 du 22 avril 1941

Art. premier.

1) Quiconque reproduit abusivement dans un but lucratif, par quelque procédé que ce soit, la composition graphique d’œuvres ou de parties d’œuvres littéraires, dramatiques, scientifiques, didactiques et musicales, protégées par la loi no 633 du 22 avril 1941, modifiée par la suite, ou qui, sans participer à la reproduction, mais en étant au courant de celle­ci, met dans le commerce, détient en vue de la vente ou introduit dans un but lucratif lesdites reproductions dans le territoire de l’État, est passible d’une amende administrative de 1 000 000 à 3 000 000 de lires et, dans des cas particulièrement graves, d’une amende pouvant aller jusqu’à 10 000 000 de lires.

2) Ne sont considérées comme ayant un but lucratif ni l’utilisation de reproductions de textes musicaux pour une activité didactique, d’étude et de recherche, y compris les exercices et les séances liés aux activités musicales d’amateurs et à celles exercées par des associations et des fondations à but non lucratif, ni l’utilisation pour d’autres manifestations publiques de textes musicaux qu’il est impossible d’acheter sur le marché.

Art. 2.

1) Les montants qui découlent de l’application des sanctions pécuniaires prévues par l’article premier et par les lois nos 406 du 29 juillet 1981 et 400 du 20 juillet 1985 sont versés à l’Organisme national d’aide et de prévoyance des peintres et sculpteurs, des musiciens, des écrivains et des auteurs dramatiques.

Art. 3.

1) Les articles 177, 178 et 179, ainsi que le dernier alinéa de l’article 172 de la loi no 633 susmentionnée du 22 avril 1941, sont supprimés.

2) Les articles 52, 53, 54, 55 et 56 du règlement d’exécution de la loi no 633 du 22 avril 1941 sur la protection du droit d’auteur et d’autres droits connexes à l’exercice de celui­ci, approuvé par le décret royal no 1369 du 18 mai 1942, sont supprimés.

Entrée en vigueur : 27 mai 1993.
