Provisions Concerning the Unlawful Duplication,
Reproduction, Import, Distribution and Sale,
Public Showing and Transmission
of Cinematographic Works

(of July 20, 1985)*

Article 1. Any person who, with gainful intent, unlawfully duplicates or reproduces, by whatever means, cinematographic works intended for the cinema or television network, or, even without having recourse to duplication or reproduction processes, places on the market, holds for sale, brings into the territory of the State for profitmaking purposes, publicly shows or broadcasts on television such duplicates or reproductions, shall be punished by imprisonment for between three months and three years and by a fine of between 500,000 and 6,000,000 lire.

The penalty shall not be less than a minimum of six months, and the fine not less than one million lire if the offense is of sufficient gravity.

Article 2. The sentence for the offenses contemplated in the foregoing Article shall include publication of the judgment in one or more daily newspapers and in one or more specialized periodicals.

Règles applicables en matière de copie, de reproduction,

d’importation, de distribution et de vente, de projection publique et de transmission non autorisées

d’oeuvres cinématographiques

(du 20 juillet 1985)*

Article premier. – Quiconque copie ou reproduit sans autorisation et dans un but de lucre, par quelque

procédé que ce soit, des oeuvres cinématographiques destinées au réseau de cinéma ou de télévision ou bien,

même sans avoir recours à la copie ou à la reproduction, met dans le commerce, détient en vue de la vente,

introduit sur le territoire de l’Etat dans un but de lucre, projette en public ou transmet par le moyen de la

télévision lesdites copies ou reproductions sera puni d’une peine de prison de trois mois à trois ans et d’une

amende de 500.000 à 6.000.000 de lires.

La peine ne sera pas inférieure à six mois de prison et l’amende ne sera pas inférieure à un million de

lires si la gravité des faits le justifie.

Art. 2. – Toute condamnation motivée par les délits mentionnés à l’article précédent est assortie de la

publication de la sentence dans un ou plusieurs quotidiens et dans un ou plusieurs périodiques spécialisés.
