SUMMARY

This enactment amends the Patent Act to permit the correction of past incorrect fee payments in c_ertain situations and provides that the standing committee of each House of Parliament shall consider candidates for appointment to the advisory committee.

CHAPTER 18

An Act to amend the Patent Act

[Assented to 5th May, 2005]

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

PATENT ACT

1. Subsection 21.18(2) of the Patent Act, as enacted by section 1 of chapter 23 of the Statutes of Canada, 2004, is replaced by the following:

(2) The standing committee of each House of Parliament that normally considers matters related to industry shall assess all candidates for appointment to the advisory .committee and make recommendations to the Minister and the Minister of Health on the eligibility and qualifications of those candidates.

2. The Act is amended by adding the following after section 78.5:

78.6 (1) If, before the day on which this section comes into force, a person has paid a prescribed fee applicable to a small entity, within the meaning of the Patent Rules as they read at the time of payment, but should have paid the prescribed fee applicable to an entity other than a small entity and a payment equivalent to the difference between the two amounts is submitted to the Commissioner in accordance with subsection (2) either before or no later than twelve months after that day, the payment is deemed to have been paid on the day on which the prescribed fee was paid, regardless of whether an action or other proceeding

LOI SUR LES BREVETS

1. Le paragraphe 21.18(2) de Ia Loi sur les brevets, edicte par !'article 1 du chapitre 23 des Lois du Canada (2004), est remplace par ce qui suit:

(2) Le comite permanent de chaque chambre du Parlement habituellement charge des ques­ tions concernant l'industrie evalue les candidats en vue de leur nomination aun poste au cornite consultatif et presente au rninistre et au rninistre

2. La meme loi est modifiee par adjonc• tion, apres I'article 78.5, de ce qui suit: .

78.6 (1) Si, avant !'entree en vigueur du present article, une personne a paye Ia taxe reglementaire relative aune petite entite, au sens des Regles sur les brevets dans leur version applicable a Ia date du paiement, alors qu'elle aurait du payer celle relative aune entite autre qu'une petite entite, et qu'elle verse la diffe­ rence au connnissaire aux brevets en conformite avec le paragraphe (2), avant la date d'entree en vigueur du present article ou au plus tard douze mois apres cette date, le versement est repute avoir ete fait a la date du paiement de la taxe reglementaire, independamment de toute ins­ tance ou autre procedure engagee al'egard du

relating to the patent or patent application in respect of which the fee was payable has been commenced or decided.

Infonnation to (2) Any person who submits a payment to be provided the Commissioner in accordance with subsec­

tion (1) is required to provide information with respect to the service or proceeding in respect of which the fee was paid and the patent or application in respect ofwhich the fee was paid.

No refund (3) A payment submitted in accord~ce with subsection (1) shall not be refunded. · ·

Action and (4) No action or proceeding for any com­ proceedings pensation or damages lies against Her Majestyban:ed

in right of Canada in respect of any direct or indirect consequence resulting from the applica­ tion of this section.

Application (5) For greater certainty, this section. also applies to applications for patents mentioned in sections 78.1 and 78.4.

2.1 The Act is amended by adding, after section 103, Schedules 1 to 4 set out in An Act to amend the Patent Act and the Food and Drugs Act (The Jean Chretien Pledge to Africa), being chapter 23 of the Statutes of Canada, 2004.

COMING INTO FORCE

·Order in council 3. (1) Sections 1 and 2.1 come into force on the day on which An Act to amend the Patent Act and the Food and Drugs Act (The Jean Chretien Pledge to Africa), being chap­ ter 23 of the Statutes of Canada, 2004, comes into force.

(2) Section 2 comes into force on a day to be rtxed by order of the Governor in Council.

(4) II ne peut etre intente d'action en recouvrement centre Sa Majeste du chef du Canada a l'egard de toutes repercussions ­ directes ou indirectes -resultant de !'applica­ tion du present article.

(5) Il est entendu que le present article s'applique aussi aux demandes de brevet visees par les articles 78.1 et 78.4.

2.1 La meme loi est modifiee par adjonc­ tion, apres !'article 103, des annexes 1 a4 qui figurent dans la Loi modijiant Ia Loi sur les brevets et Ia Loi sur les aliments et drogues (engagement de Jean Chretien envers !'A­ frique), chapitre 23 des Lois du Canada (2004).

ENTREE- EN VIGUEUR

3. (1) Les articles 1 et 2.1 entrent en vigueur a la date d'entree en vigueur de la Loi modifiant Ia Loi sur les brevets et Ia Loi sur les aliments et drogues .(engagement de Jean Chretien envers l'Afrique), chapitre 23 des Lois du Canada (2004).

(2) L'article 2 entre en vigueur a la date rtxee par decret.
