Details Details Year of Version 1999 Dates Entry into force: May 5, 1998 Adopted: April 30, 1998 Type of Text IP-related Laws Subject Matter Copyright and Related Rights (Neighboring Rights), Enforcement of IP and Related Laws, IP Regulatory Body Notes Article 12(1)(d) of the Decree-Law No. 17/98/M of May 4, 1995 refers to the offenses stipulated in Articles 217, 244, and 320 of the Criminal Code, in Article 190 of the Copyright Code (approved by Decree-Law No. 46980 of April 27, 1966), and in Article 5 of Law No. 4/85/M of November 25, 1985, on the Protection against Unlawful Reproduction of Phonograms and Videograms.
Article 21 states that Article 48 and Section II of Chapter IV of Decree-Law No. 66/95/M of December 18, 1995, governing Foreign Trade Operations; and Code of Administrative Procedure are also applicable to the offenses and procedures as specified in the Decree-Law.

According to Article 222(d) of Decree-Law No. 43/99/M of August 16, 1999, on the Regime of Copyright and Related Rights, Article 2 of this Decree-Law No. 17/98/M of May 4, 1995 regarding the protection of computer programs was repealed.
However, in 1999, this Decree-Law was wholly repealed in accordance with Article 49(1) of Decree-Law No. 51/99/M of September 27, 1999, regulating the Commercial and Industrial Activities related to Computer Programs, Phonograms and Video Products.

Article 23(1) of the Decree-Law states that it shall enter into force on the day after its publication. The Decree-Law was published on May 4, 1998, and therefore came into force on May 5, 1998.
Article 23(2- 3) of the Decree-Law states that Articles 3, 4 and 6 shall enter into force 30 days after its publication.
