Reglament de creació de l’Oficina de Marques del Principat d’Andorra (OMPA)

El Govern, en aplicació de la disposició final primera de la Llei de marques, d’11 de maig de 1995, en la sessió del dia 2 de novembre de 1995 acorda aprovar el Reglament de creació de l’Oficina de Marques del Principat d’Andorra, amb el text següent:

Article 1

Es crea l’Oficina de Marques del Principat d’Andorra, amb les sigles OMPA, com a òrgan de l’Administració general adscrit al cap de Govern.

Article 2

L’objecte de l’OMPA és la realització de les funcions que li encomanen la Llei de marques, la Llei de taxes de l’Oficina de Marques i els reglaments que les despleguen.

Article 3

El director de l’OMPA és nomenat pel Govern.

Corresponen al director de l’OMPA les funcions derivades de la Llei de marques i de la Llei de taxes de l’Oficina de Marques, com també dels reglaments que les despleguen, i en especial:

• organitzar, dirigir i controlar el funcionament de l’OMPA,

  • assumir compromisos amb tercers, en aquelles matèries específiques de gestió pròpies del funcionament de l’OMPA,

  • proposar al Govern l’adopció de les disposicions reglamentàries oportunes per optimitzar el funcionament de l’OMPA,

  • proposar al Govern la modificació de les quotes tributàries establertes en la Llei de taxes de l’Oficina de Marques,

  • proposar al Govern les necessitats de contractació de personal i l’adopció de les mesures adequades per augmentar-ne l’eficiència i la competència professional.

Reglament de creació de l’Oficina de Marques del Principat d’Andorra (OMPA)

Article 4

Tot el personal empleat a l’OMPA depèn jeràrquicament del director i queda subjecte a la normativa laboral aplicable al personal al servei del Govern.

Article 5

El pressupost i la comptabilitat de l’OMPA, i també el seu control, s’estableix d’acord amb les disposicions de la Llei general de les finances públiques.

Disposició final primera

L’OMPA fixarà la data a partir de la qual pot rebre sol· licituds de registre de marca. Aquesta data serà anterior al dia 6 de desembre de 1996.

Disposició final segona

El present Reglament entrarà en vigor el mateix dia de la seva publicació en el Butlletí Oficial del Principat d’Andorra.

Regulations for the creation of the Office of Trademarks of the Principality of Andorra (OMPA)

In application of the first final provision of the Trademark Law of May 11, 1995, the Government does hereby approve the following Regulations Governing the Creation of the Trademark Office of the Principality of Andorra in its session of November 2, 1995:

Article 1

The Trademark Office of the Principality of Andorra, hereinafter referred to as OMPA (Oficina de Marques del Principat d'Andorra ), shall be established as a body of the general administration (organ de l'Administració general ), reporting to the head of the Government.

Article 2

The object of OMPA is to perform the tasks assigned to it by the Trademark Law, the Law on Trademark Office Fees and the regulations derived therefrom.

Article 3 1

The director of OMPA shall be appointed by the Government. The director of OMPA shall perform the duties derived from the Trademark Law, the Law on Trademark Office Fees and the regulations developed subsequent to these laws, and shall be specifically responsible for:

• organising, directing and monitoring OMPA operations;

  • undertaking commitments with third parties on those management tasks which are the specific province of OMPA;

  • proposing regulations to be adopted by the Government in an effort to optimise OMPA operations;

  • proposing any changes to be made by the Government in the fees established by the Law on Trademark Office Fees.

  • proposing that the Government hire the necessary personnel and adopt the appropriate measures to increase efficiency and professional competence.

Article 4

All employees of OMPA shall answer to the director and shall be subject to the labour regulations applicable to government employees.

Article 5

The OMPA budget, accounting procedures and control thereof shall be established in accordance with the provisions of the General Law on Public Finance.

First final provision 2

OMPA shall set the date as of which applications for trademark registration may be submitted. This date shall be prior to December 6, 1996.

Regulations for the creation of the Office of Trademarks of the Principality of Andorra (OMPA)

The foregoing regulations shall take effect on the day on which they are published in the Official Bulletin of the Principality of Andorra.3
