SUMÁRIO:

I.     Constituem desenhos os elementos respeitantes à aparência (total ou parcial) de um produto correspondentes a «linhas, contornos, cores, forma, textura ou materiais do próprio produto e da sua ornamentação».

II.    São registáveis os desenhos: a) novos e b) singulares ou c) conhecidos mas envolvendo recombinação ou redisposição de elementos em termos tais que lhes confiram singularidade;

III.   O requisito novidade é aferível no momento do pedido de registo ou da reivindicação de prioridade;

IV.  A singularidade do desenho afere-se em função da produção de diversa impressão global (leia-se «sensação», «efeito») num específico destinatário, a saber, o «utilizador informado»;

V.   O olhar a emular é o de um sujeito mais atento, avisado e informado do que o consumidor comum, que conhece desenhos existentes no sector económico apreciado, reconhece os componentes usuais desses desenhos, revela interesse pela matéria e exibe um grau de atenção não mediano mas elevado;

VI.  A novidade está umbicalmente ligada à originalidade do gesto de criação cultural.
