Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure

Communication of the Republic of Hungary Relating to the Change in Fees Charged by the National Collection of Agricultural and Industrial Microorganisms (NCAIM)

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify him of the receipt, on December 28, 1998, of a written communication, dated December 18, 1998, from the Government of the Republic of Hungary informing him of the change in fees charged by the National Collection of Agricultural and Industrial Microorganisms (NCAIM), University of Horticulture and Food Industry, an international depositary authority under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977, and amended on September 26, 1980 (see Budapest Notification No. 51 of May 2, 1986). The new schedule of fees is attached.

The said schedule of fees will apply as from the thirtieth day following the date (January 29, 1999) of its publication in the January 1999 issue of the WIPO periodical Intellectual Property Laws and Treaties, that is, as from February 28, 1999 (see Rule 12.2(c) of the Regulations under the Budapest Treaty) and will replace the one published in the February 1993 issue of Industrial Property (see Budapest Notification No. 112 of February 10, 1993).

Text of the Communication of the Government of the Republic of Hungary, dated December 18, 1998, Relating to a Change in the Fees Charged by the National Collection of Agricultural and Industrial Microorganisms (NCAIM), University of Horticulture and Food Industry

Schedule of Fees

For each deposited microorganism strain, the National Collection of Agricultural and Industrial Microorganisms (NCAIM), University of Horticulture and Food Industry, will charge the following fees to the depositor:

      Hungarian forints
  (a) for storage 108,000
  (b) for the issuance of a receipt in attestation of the deposit (except for the receipt issued free of charge in the case of original or new deposits) if information is requested 6,000
  (c) for a viability test and for the issuance of a viability statement 15,000
  (d) for the furnishing of samples on request made after publication of the patent application 25,000
