Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure

Communication by the Government of the Kingdom of Spain Relating to a Change in the Fees Charged by the Colección Española de Cultivos Tipo (CECT)

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify him of the receipt, on April 23, 2003, of a written communication, dated April 7, 2003, from the Government of the Kingdom of Spain, relating to a change in the fees charged by the Colección Española de Cultivos Tipo (CECT), an international depositary authority under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977, as amended on September 26, 1980 (see Budapest Notification No. 106 of April 27, 1992). The text of that communication is attached.

The fees set forth in the said communication will apply as from April 1, 2003. The said fees will replace the fees as published in the May 1992 WIPO issue of Industrial Property/La Propriété industrielle.

Text of the Communication by the Government of the Kingdom of Spain dated April 7, 2003, Relating to a Change in the Fees Charged by the Colección Española de Cultivos Tipo (CECT)

COMMUNICATION

In accordance with Rule 12.2 of the Regulations under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, I have the honor to hereby notify you that the amounts of fees charged by the Colección Española de Cultivos Tipo (CECT) as an international depositary authority for the deposits of microorganisms relating to patent applications, will be modified as follows, with effect from April 1, 2003:

  Storage of Euros
    (a) original deposits (Rule 6.1) 550
    (b) new deposits 80
    (c) extension of the duration of the storage beyond the period provided for in Rule 9 of the Regulations under the Budapest Treaty, per year 25
       
  Issuance of viability statement (Rule 10.2)  
    (a) where a viability test is requested 110
    (b) on the basis of the most recent viability test 45
       
  Furnishing of samples (Rule 11) 110
  Communication of information (Rule 7.6) 110
