Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure

Communication by the Government of Japan relating to Changes in the Address and the Schedule of Fees of the National Institute of Technology and Evaluation, Patent Microorganisms Depositary (NPMD)

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify the receipt on January 10, 2013, of a communication of the Government of Japan, dated January 8, 2013, regarding changes in the address and the schedule of fees of the National Institute of Technology and Evaluation, Patent Microorganisms Depositary (NPMD), an international depositary authority under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977, and amended on September 26, 1980 (see Budapest Notification No. 215 of April 1, 2004).

According to Article 7.1(b) of the Budapest Treaty, the change in the address shall take effect on April 1, 2013. According to Rule 12.2(a) of the Regulations under the Budapest Treaty, the changes in the schedule of fees shall also take effect on April 1, 2013.

Text of the communication by the Government of Japan relating to changes in the address and the schedule of fees of the National Institute of Technology and Evaluation, Patent Microorganisms Depositary (NPMD)

COMMUNICATION

Patent Microorganisms Depositary (NPMD), National Institute of Technology and Evaluation (NITE) will change the address and the schedule of fees from April 1, 2013 as follows:

1. New Address: #122, 2-5-8 Kazusakamatari, Kisarazu-shi, Chiba 292-0818, Japan

2. New Schedule of Fees:


  (a) Storage (for 30 years) 1 JPY
    - original deposit 175,000
    - new deposit 33,000
  (b) Issuance of attestation under Rule 8.2 3,000
  (c) Issuance of viability statement  
    (i) if the viability test is to be carried out 1 29,000
    (ii) based on the last viability test 3,000
  (d) Furnishing of a sample 1, 2 41,000
  (e) Issuance of communication under Rule 7.6 3,000

1. Japanese consumption tax will be charged for (a), (c)(i) and (d).
2. To ship abroad, handling and delivery cost will be charged separately.

The Government of Japan guarantees that NPMD will continue to fulfill the requirements specified in Article 6(2) of the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure.

The Government of Japan considers that this communication will be disclosed to all Contracting States and the Intergovernmental Industrial Property Offices.
