The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify him of the receipt, on July 31, 1989, of a written communication from the European Patent Organisation (EPO) relating to the Deutsche Sammlung von Mikroorganismen und Zellkulturen GmbH (DSM), an international depositary authority under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977, as amended on September 26, 1980 (see Budapest Notification No. 22 of August 27, 1981), informing that the requirement of the DSM under Rule 6.3 of the Regulations under the Budapest Treaty, concerning the quantity of microorganisms to be deposited, has been amended. The text of the said communication is attached.
The requirement of the DSM, as so amended, replaces the requirement concerning the quantity of microorganisms to be deposited under the Budapest Treaty which was published in the April 1988 issue of Industrial Property/La Propriété industrielle (see Budapest Notification No. 69 of April 5, 1988).

Text of the Written Communication of the European Patent Organisation (EPO), Relating to the Deutsche Sammlung von Mikroorganismen und Zellkulturen GmbH (DSM)
DSM'S REQUIREMENTS UNDER RULE 6.3 OF THE BUDAPEST TREATY
Item 1 of the DSM's requirements under Rule 6.3 of the Budapest Treaty, as published in the April 1988 issue of Industrial Property, pages 139 to 141, is amended to read as follows:
"1. DSM must be supplied with two preparations of any microorganism to be deposited.
a. Bacteria and fungi should, where possible, be deposited in the form of active cultures.
b. Plasmids as isolated DNA preparations should be in a minimum quantity of 2 x 20µg.
c. Bacteriophages should be deposited in minimum quantities of 2 x 5ml having a minimal titre of 1 x 109 pro ml".
