Contracting Parties Convention on Cybercrime Lithuania

Declarations, Reservations

Declarations made upon ratification and confirmed on April 26, 2004:
1. "In accordance with Article 40 and Article 2 of the Convention, the Republic of Lithuania declares that criminal liability for the act described in Article 2 of the Convention occurs upon access to the whole or any part of a computer system without right by infringing security measures of a computer or a computer network."
2. "Pursuant to Article 40 and Article 27, paragraph 9, sub-paragraph e, of the Convention, the Republic of Lithuania declares that, for reasons of efficiency, requests for mutual assistance made under Article 27, paragraph 9, are to be addressed to the above-designated central authorities."
3. "Pursuant to Article 24, paragraph 7, sub-paragraph a, of the Convention, the Republic of Lithuania declares that the Ministry of Justice and the General Prosecutor's Office of the Republic of Lithuania are designated as responsible authorities to perform the functions mentioned in Article 24, paragraph 7, sub-paragraph a."
4. "Pursuant to Article 27, paragraph 2, sub-paragraph a, of the Convention, the Republic of Lithuania declares that the Ministry of Justice and the General Prosecutor's Office of the Republic of Lithuania are designated as central authorities to perform the functions mentioned in Article 27."
5. "Pursuant to Article 35, paragraph 1, of the Convention, the Republic of Lithuania declares that the Police Department under the Ministry of the Interior of the Republic of Lithuania is designated as a competent authority to perform the functions mentioned in Article 35."

Reservations made upon ratification and confirmed on April 26, 2004:
1. "In accordance with Article 42 and Article 4, pararaph 2, of the Convention, the Republic of Lithuania declares that criminal liability occurs if the acts described in Article 4 of the Convention result in serious harm."
2. "In accordance with Article 42 and Article 29, pararaph 4, of the Convention, the Republic of Lithuania declares that it reserves the right to refuse to execute the request for preservation of the data in cases where there is reason to believe that at the time of disclosure the offence, on which the request for preservation of the data is based, is not considered as a crime by the laws of the Republic of Lithuania."
