5BNature and Legal Regime
1.—(1) The Spanish Patent and Trademark Office is an autonomous body attached
to the Ministry of Industry and Energy and reporting to it through the Under-Secretariat.
(2) The Spanish Patent and Trademark Office has its own legal personality and
authority to work in pursuance of its objectives, and is governed by Law 17/1975, of May
2, 1975, Creating the Autonomous Body, the “Registry of Industrial Property” [Ley
17/1975, de 2 de mayo, sobre creación del organismo autónomo Registro de la
Propiedad Industrial] and Law 21/1992, of July 16, 1992, on Industry [Ley 21/1992, de
16 de julio, de Industria], and also by the terms of the General Budgetary Law [Ley
General Presupuestaria] (RCL 1998/1966 and 2287) and any other provisions applicable
to autonomous bodies within the General State Administration.
6BAims
2. The Spanish Patent and Trademark Office shall be responsible for the conduct of
the administrative activity entrusted to the State in the industrial property field as
provided in currently applicable legislation and international treaties, and shall be the
instrument of technological policy in that field.
7BFunctions
3. The following functions are entrusted to the Spanish Patent and Trademark
Office for the accomplishment of its aims:
1. administrative action serving to effect the recognition and maintenance of
protection by registration of the various manifestations of industrial property,
namely inventions, topographies of semiconductor products, creations of
form and distinctive signs, including the processing and settlement of files,
register entries for the record and the preservation and publicity of
documentation;
2. the efficient periodical dissemination of technological information that has
been registered, without prejudice to such other types of special publication
as may prove advisable;
3. implementation, within the limits of its authority, of international treaties in
force in the industrial property field, and proposal where appropriate of
adherence by Spain to those that are not yet in force for it, and general
promotion of international relations in that field;
4. promotion of initiatives and conduct of activities to bring about greater
awareness and more appropriate protection of industrial property, both in the
national and in the international field, and maintenance of direct relations
with whatever Spanish or foreign organizations and bodies concern
themselves with such matters;
5. information on preliminary draft legislation and other provisions of general
character that have to be enacted in the field of industrial property;
6. the making of pronouncements on matters concerning industrial property
when required to do so by authorities, courts or official bodies;
7. any other function that applicable legislation currently entrusts to the Spanish
Patent and Trademark Office, or such as may henceforth be expressly
entrusted to it in its specific areas of competence.
8BStructure
4.—(1) The basic general structure of the Spanish Patent and Trademark Office, as
provided in Law 17/1975 of May 2, 1975, shall consist of the following bodies:
(a) the Management Board;
(b) the Director of the Office;
(c) the Secretariat General;
(d) the Patents and Technological Information Department;
(e) the Distinctive Signs Department;
(f) the Legal Coordination and International Relations Department.
(2) There shall be a delegate representing the General State Administration
assigned to the management of the Office, whose rank shall be specified in the
appropriate schedule of appointments.
9BManagement Board
5.—(1) The Management Board shall be the supreme governing body of the Office
and shall have the broadest functions for directing and supervising the management
thereof.
(2) The Management Board shall be composed of a President, who shall be the
Under-Secretary of the Ministry of Industry and Energy, and of the following ordinary
members:
(a) the Director of the Spanish Patent and Trademark Office;
(b) two representatives of the Ministry of Industry and Energy;
(c) one representative from each of the following Ministries: Foreign Affairs,
Education and Culture, Economy and Finance, and Justice;
(d) one representative from each of the following bodies: Higher Board of
Chambers of Commerce, Industry and Navigation, and Higher Board of
Scientific Research;
(e) the Head of the Legal Department of the Ministry of Industry and Energy;
(f) the Secretary General of the Spanish Patent and Trademark Office, who shall
provide the secretariat of the Board and take part in meetings with the right to
speak and vote.
(3) The Ministry of Industry and Energy shall appoint those members of the Board
who have representative character. Those serving as representatives of ministerial
departments shall be appointed and removed on a proposal by the head of department
concerned. Those serving as representatives of other organizations or bodies shall be
appointed on a proposal by the organization or body concerned.
(4) The President of the Management Board shall appoint a Vice-President from
among the ordinary members.
(5) The members of the Board who are serving as representatives of ministerial
departments shall be in the Director General category or shall have responsibilities of
comparable rank, and may delegate an Under-Director General from their department to
attend meetings of the Board.
(6) The powers of the Management Board shall be
(a) to set out the policy of the Office and lay down guidelines for its operation;
(b) to approve the management activity of the Director of the Office;
(c) to be informed of the operation of the Spanish Patent and Trademark Office
by means of reports periodically submitted by the Director;
(d) to approve the preliminary draft budget of income and expenditure, and the
end-of-year accounts;
(e) to approve the annual report on the Office’s activities;
(f) to negotiate and enter into agreements on matters that are brought to its notice
on account of their nature and importance;
(g) any that are specific to its status as supreme body of the Office.
(7) Persons who, without being members of the Board, have special qualifications
may attend its meetings when invited to do so by the President.
(8) The Management Board shall meet in ordinary session once every year and also
whenever convened by its President. The Board’s deliberations and decision-making
procedure shall conform to the provisions of Chapter II of Title II of Law 30/1992 of
November 26, 1992, on the Legal Regime of Public Administrations and Common
Administrative Procedure [Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las
Administraciones Públicas y del Procedimiento Administrativo Común].

6.—(1) The Director of the Spanish Patent and Trademark Office shall implement
the policies and guidelines set out by the Management Board, and shall exercise supreme
authority over the corresponding services.
(2) The Director of the Spanish Patent and Trademark Office shall be in the
Director General category and shall be appointed and removed by Royal Decree on a
proposal by the Ministry of Industry and Energy.
(3) The competence of the Director shall include
(a) exercising administrative authority over all the services of the Office;
(b) overseeing and controlling all departments under his responsibility and
establishing the internal regime governing them;
(c) settling matters within the competence of the Spanish Patent and Trademark
Office and any appeals filed against decisions by bodies under its authority;
(d) drawing up the preliminary draft budget of income and expenditure, and
authorizing and ordering expenditure specific to the individual departments
within the limits of the credit authorized, with the exception of that within the
reserved jurisdiction of the Board of Ministers or the Minister of the
Department, and also contracting obligations and ordering the corresponding
payments;
(e) signing, on behalf of the Office, contracts relating to matters specific to his
competence;
(f) exercising administrative, managerial and disciplinary authority over the staff
under his authority, as provided in the laws in force;
(g) ordering paid service assignments;
(h) issuing service instructions and orders to ensure the smooth operation of the
Office;
(i) communicating direct on all service matters with such Spanish or foreign
organizations and entities as concern themselves or have a connection with
industrial property;
(j) assuming the representation of the Spanish Patent and Trademark Office in
national and international dealings in cases of non-attendance by the
President of the Management Board, and exercising all the other powers,
prerogatives and functions entrusted to him by the provisions in force.
11BSecretariat General
7.—(1) The Secretariat General, which shall have the organic rank of Under-
Directorate General, shall be the body of the Spanish Patent and Trademark Office
responsible for the Office’s general and administrative services.
(2) It shall be responsible for the following functions in particular:
(a) drawing up the annual preliminary draft budget of income and expenditure of
the Office;
(b) directing and managing human resources and communicating with the
Office’s staff representation bodies;
(c) ensuring the economic and financial management of the Office and engaging
in administrative negotiations, and also presiding over the Office’s
negotiating bodies;
(d) directing the development and implementation of the Office’s
computerization plans and the functions connected with the computer
applications specified therein, and also technical assistance and support
services in that area for the benefit of others within the Office;
(e) managing archiving, information and deposit services and publications and
overseeing the internal regime;
(f) acting as the normal channel of communication with ministerial departments,
organizations and bodies that entertain relations with the Spanish Patent and
Trademark Office;
(g) managing affairs relating to the College of Industrial Property Agents;
(h) dealing with matters of general character that have not been assigned to other
departments of the Office.
(3) The Head of the Secretariat General shall temporarily replace the Director of
the Office in the event of the latter’s absence, illness or unavailability.
12BPatents and Technological Information Department
8.—(1) The Patents and Technological Information Department, which shall have
the organic rank of Under-Directorate General, shall be responsible for the administrative
action required for the recognition and maintenance of the protection by registration of
patents, topographies of semiconductor products, utility models and industrial and artistic
designs. It shall likewise be responsible for bringing the technological information
contained in patent documents to the notice of concerned public and private undertakings,
research bodies and any other entities with a view to promoting technological innovation.
(2) It shall be responsible for the following functions, in particular,
(a) receiving, processing and studying, and proposing decisions on, those
application files for the grant of patents, topographies of semiconductor
products, utility models and industrial and artistic designs and invalidation
and termination files that are within the area of competence of the Office, and
also files relating to the licensing and transfer of rights and other events;
(b) ensuring the performance of all supporting administrative action that is
necessary for the proper discharge of the assignments entrusted to it;
(c) issuing certificates and authorized copies of the documents contained in files
in the archives that relate to specific subject matter within its competence;
(d) archiving settled files and ensuring their preservation;
(e) issuing reports and drawing up statistics on the operation, activities and
output of the various services of the Department;
(f) organizing and keeping up to date a search file of the technology content of
the patents of Spain and the main technology-generating countries;
(g) providing interested circles with access to information by means of
systematic and selective communication of the documentary files at its
disposal;
(h) analyzing and proposing in due time such action as may be expected to
improve technological information services, in coordination with
international recommendations;
(i) whatever administrative and technical action is necessary for the efficient
performance of the functions assigned to it.
13BDistinctive Signs Department
9.—(1) The Distinctive Signs Department, which shall have the organic rank of
Under-Directorate General, shall be responsible for administrative action directed
towards the recognition and maintenance of the protection by registration of national and
international marks, trade names and business signs.
(2) It shall be responsible for the following functions, in particular,
(a) receiving, processing and studying, and proposing decisions on, those
application files for the grant of all of the subject matter specifically entrusted
to it and invalidation and termination files that are within the area of
competence of the Office, and also files relating to the licensing and transfer
of rights and other events;
(b) ensuring the performance of all supporting administrative action that is
necessary for the proper discharge of the assignments entrusted to the
Department;
(c) issuing certificates and authorized copies of documents contained in the
appropriate files in the archives;
(d) archiving settled files and ensuring their preservation;
(e) issuing reports and drawing up statistics on the operation, activities and
output of the various services;
(f) whatever administrative action may be necessary for the efficient conduct of
the activities entrusted to it.
14BLegal Coordination and International Relations Department
10.—(1) The Legal Coordination and International Relations Department, which
shall have the organic rank of Under-Directorate General, shall be responsible for giving
legal support to the Director of the Office, and also for the conduct of international
relations in the industrial property field, which it shall do in coordination with the
Ministry of Foreign Affairs.
(2) It shall be responsible for the following functions, in particular,
(a) studying and proposing such amendment of the industrial property legislation
in force as may be necessary;
(b) drawing up reports on preliminary draft legislation and other provisions of
general character;
(c) drawing up reports and rulings on matters relating to industrial property that
are requested by authorities, courts and official bodies;
(d) studying, classifying and compiling collections of legal provisions, case law
and legal literature concerning industrial property, and keeping abreast of
relevant comparative legislation;
(e) ensuring the proper application, within the limits of the Office’s competence,
of international industrial property treaties in force, and making proposals as
appropriate regarding Spain’s adherence to those that are not yet in force for
it;
(f) promoting, in agreement with the Ministry of Foreign Affairs, relations and
international cooperation in the field of industrial property, and maintaining
contact with intergovernmental organizations and with such public or private
national or international bodies as may be concerned with the subject;
(g) representing the Director of the Office where necessary at international
meetings to which the Spanish Patent and Trademark Office has been
convened or in which it has to take part;
(h) directing the analysis and handling and proposing the solution of appeals
lodged against any decision of the Office, in accordance with applicable legal
provisions, and also entertaining relations with the courts;
(i) preparing international meetings and conferences on industrial property that
are held in Spain;
(j) drawing up the annual report on activities that has to be submitted to the
Management Board for consideration.
15BAssets and Economic Resources
11.—(1) The Spanish Patent and Trademark Office shall for the achievement of its
aims have its own assets and also such property and rights as may be allocated to it by the
General State Administration.
(2) The economic assets and resources of the Spanish Patent and Trademark Office
shall be the following:
(a) the credits allocated to it every year in the General Budgets of the State;
(b) the property and rights constituting its own assets and any proceeds, income
or dividends that may derive therefrom;
(c) income deriving from the fees that it is responsible for charging, and also
payments for services rendered and the proceeds from the sale of goods and
rendering of services to the public;
(d) income received from the World Intellectual Property Organization (WIPO),
the European Patent Office (EPO) and the Office for Harmonization in the
Internal Market (OHIM) under the applicable Community law and signed
international treaties, and also any other income that may be generated under
international treaties or conventions that the Spanish Government may enter
into;
(e) subsidies, voluntary contributions or donations granted or accorded to it by
national or international public or private bodies;
(f) any other ordinary or extraordinary financial resources that may be allocated
to it.
16BDeconcentration, Delegation and Allocation of Functions
12.—(1) In accordance with the provisions of HUArticle 12(2)UH of Law 30/1992, of
November 26, 1992, and HUArticle 5UH of Law 17/1975, of May 2, 1975, the following duties
of the Director of the Office are deconcentrated and transferred to the Under-Director
General of the Patents and Technological Information Department:
(a) settlement of patent files;
(b) settlement of files on topographies of semiconductor products;
(c) settlement of utility model files;
(d) settlement of files on industrial and artistic designs;
(e) settlement of files on supplementary protection certificates for drugs;
(f) settlement of files on supplementary protection certificates for phytosanitary
products.
(2) Also in accordance with the said provisions, the following duties of the Director
of the Office are deconcentrated and transferred to the Under-Director General of the
Distinctive Signs Department:
(a) settlement of files on national marks;
(b) settlement of files on international marks;
(c) settlement of files on trade names and business signs.
(3) Decisions issued by the Under-Directors of the Patents and Technological
Information and Distinctive Signs Departments shall not exhaust administrative remedies,
and appeals from them shall lie to the Director of the Spanish Patent and Trademark
Office by the lodging of an ordinary appeal as provided in the Law on the Legal Regime
of Public Administrations and Common Administrative Procedure.
(4) The Director of the Spanish Patent and Trademark Office may take over the
hearing of whatever cases he considers fit and the settlement of which belongs, either
ordinarily or by delegation, to the Under-Directors General and other bodies under the
authority of the Office, as provided in Article 14 of Law 30/1992, of November 26, 1992.
1BSOLE ADDITIONAL PROVISION
17BElimination of Bodies
The following units having the organic rank of Under-Directorate General are
hereby eliminated:
(a) Technological Information Department;
(b) Studies and International Relations Department;
(c) Patents and Designs Department.
2BSOLE TRANSITIONAL PROVISION
18BUnits and Workplaces of Organic Rank Below Under-Directorate
General
Units and workplaces of organic rank below Under-Directorate General shall
continue to exist and shall be remunerated from the same budgetary allocations until such
time as the schedules of appointments corresponding to the organic structure introduced
by this Royal Decree have been approved. The adaptation shall in no event bring about an
increase in cost to the public.
The units and workplaces forming part of the bodies eliminated by this Royal
Decree shall be provisionally allocated, by order of the Director of the Office and until
such time as the new schedule of appointments comes into effect, to the bodies provided
for in this Royal Decree, according to the responsibilities assigned to them.
3BSOLE REPEAL PROVISION
19BRepeal of Provisions
Any provisions of equal or lower rank that conflict with the provisions of this
Royal Decree are repealed, especially the Organic Regulations of the Spanish Patent and
Trademark Office approved by Royal Decree 2573/1977, of June 17, 1977 (RCL
1977/21/93 and ApNDL 11782), and amended by Royal Decree 305/1993, of February
26, 1993 (RCL 1993/714).
4BFINAL PROVISIONS
20BDevelopment Powers
First. The Ministry of Industry and Energy is authorized to adopt such measures as
may be necessary for the development and implementation of this Royal Decree.
21B udgetary Modifications
Second. The budgetary modifications necessary for the implementation of the
provisions of this Royal Decree shall be made by the Ministry of Economy and Finance.
22BEntry into Force
Third. This Royal Decree shall enter into force on the day following that of its
publication in the Official Bulletin of the State [Boletín Oficial del Estado].

Deroga Real Decreto 2573/1977, de 17-6-1977 (RCL 1977\2193 y ApNDL 11782), modificado por Real Decreto 305/1993, de 26-2-1993 (RCL 1993\714).
TEXTO:
El Real Decreto 2573/1977, de 17 de junio (RCL 1977\2193 y ApNDL 11782), aprobó el Reglamento Orgánico del Registro de la Propiedad Industrial, en cumplimiento de lo previsto en la disposición final primera de la Ley 17/1975, de 2 de mayo (RCL 1975\916 y ApNDL 11781), norma que configuró al Registro como organismo autónomo.
Entre otros aspectos, la Ley y el Reglamento citados establecieron que la estructura básica del Registro estaría constituida por el Consejo de Dirección, el Director del organismo, la Secretaría General y los Departamentos.
Con posterioridad, la Ley 21/1992, de 16 de julio (RCL 1992\1640), de Industria, en su disposición adicional primera, sustituyó la denominación del Registro por la actual de Oficina Española de Patentes y Marcas y modificó las funciones y estructura del Consejo de Dirección. Por su parte, el Real Decreto 305/1993, de 26 de febrero (RCL 1993\714), modificó parcialmente el Reglamento Orgánico de la Oficina Española de Patentes y Marcas, adecuando determinados preceptos de dicho Reglamento a lo previsto en la citada Ley de Industria y en la Ley 30/1992, de 26 de noviembre (RCL 1992\2512, 2775 y RCL 1993\246), de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común.
Establecida la estructura orgánica básica del Ministerio de Industria y Energía por los Reales Decretos 839/1996, de 10 de mayo (RCL 1996\1592), y 1889/1996, de 2 de agosto (RCL 1996\2211), resulta conveniente proceder a la adaptación de la Oficina Española de Patentes y Marcas, organismo autónomo adscrito al Ministerio de Industria y Energía, a través de la Subsecretaría.
Las modificaciones que el presente Real Decreto introduce en la regulación del organismo suponen una simplificación de su estructura orgánica, suprimiendo uno de los actuales Departamentos de la Oficina, así como una nueva regulación del Consejo de Dirección, órgano superior de gobierno de la Oficina.
En su virtud, a propuesta conjunta de los Ministros de Administraciones Públicas y de Economía y Hacienda, de acuerdo con el Ministro de Industria y Energía y con el Consejo de Estado, y previa deliberación del Consejo de Ministros en su reunión de 24 de julio de 1997, dispongo:
Artículo 1. Naturaleza y régimen jurídico.
1. La Oficina Española de Patentes y Marcas es un organismo autónomo, adscrito al Ministerio de Industria y Energía, a través de la Subsecretaría.
2. La Oficina Española de Patentes y Marcas tiene personalidad jurídica propia y capacidad de obrar para el cumplimiento de sus fines y se rige por la Ley 17/1975, de 2 de mayo, sobre creación del organismo autónomo Registro de la Propiedad Industrial; Ley 21/1992, de 16 de julio, de Industria, así como por lo establecido en la Ley General Presupuestaria (RCL 1988\1966 y 2287), y en las demás disposiciones de aplicación a los organismos autónomos de la Administración General del Estado.
Artículo 2. Fines.
La Oficina Española de Patentes y Marcas tendrá a su cargo la realización de la actividad administrativa que corresponde al Estado en materia de propiedad industrial, conforme a la legislación y convenios internacionales vigentes, y será el instrumento de la política tecnológica en este campo.
Artículo 3. Funciones.
Para la consecución de sus fines, están atribuidas a la Oficina Española de Patentes y Marcas las siguientes funciones:
1. Las actuaciones administrativas encaminadas al reconocimiento y mantenimiento de la protección registral a las diversas manifestaciones de la propiedad industrial, invenciones, topografías de productos semiconductores, creaciones de forma y signos distintivos, comprendiendo la tramitación y resolución de expedientes, las anotaciones para constancia y la conservación y publicidad de la documentación.
2. Difundir eficazmente, de forma periódica, la información tecnológica objeto de registro, sin perjuicio de otro tipo de publicaciones especiales que parezcan aconsejables.
3. Aplicar, dentro de su competencia, los convenios internaciones vigentes en materia de propiedad industrial, proponiendo, en su caso, la participación de España en aquellos que aún no estén en vigor para ella, y, en general, facilitar el desarrollo de las relaciones internacionales en este campo.
4. Promover iniciativas y desarrollar actividades conducentes al mejor conocimiento y a la más adecuada protección de la propiedad industrial, tanto en el orden nacional como en el internacional, y mantener relaciones directas con cuantos organismos y entidades españolas o extranjeras se ocupen de estas materias.
5. Informar sobre anteproyectos de ley y demás disposiciones de carácter general que hayan de dictarse en materia de propiedad industrial.
6. Emitir dictámenes sobre cuestiones referentes a propiedad industrial cuando para ello sea requerido por las autoridades, tribunales o entidades oficiales.
7. Cualquier otra función que la legislación vigente atribuya actualmente a la Oficina Española de Patentes y Marcas o las que, en lo sucesivo, le sean expresamente encomendadas en las materias propias de su competencia.
Artículo 4. Estructura.
1. La estructura general básica de la Oficina Española de Patentes y Marcas, en el marco de lo dispuesto en la Ley 17/1975, de 2 de mayo, estará constituida por los siguientes órganos:
a) El Consejo de Dirección.
b) El Director del organismo.
c) La Secretaría General.
d) El Departamento de Patentes e Información Tecnológica.
e) El Departamento de Signos Distintivos.
f) El Departamento de Coordinación Jurídica y Relaciones Internacionales.
2. Existirá una Intervención Delegada de la General de la Administración General del Estado adscrita a la Dirección del organismo y con el nivel que se determine en la correspondiente relación de puestos de trabajo.
Artículo 5. El Consejo de Dirección.
1. El Consejo de Dirección es el órgano superior de gobierno de la Oficina y tiene las más amplias funciones de dirección y control de gestión del organismo.
2. El Consejo de Dirección estará formado por un Presidente, que será el Subsecretario del Ministerio de Industria y Energía, y por los siguientes miembros como Vocales:
a) El Director de la Oficina Española de Patentes y Marcas.
b) Dos representantes del Ministerio de Industria y Energía.
c) Un representante de cada uno de los siguientes Ministerios: Asuntos Exteriores, Educación y Cultura, Economía y Hacienda y Justicia.
d) Un representante por cada una de las siguientes entidades: Consejo Superior de Cámaras de Comercio, Industria y Navegación y Consejo Superior de Investigaciones Científicas.
e) El Jefe del Servicio Jurídico del Ministerio de Industria y Energía.
f) El Secretario general de la Oficina Española de Patentes y Marcas, que desempeñará la Secretaría del Consejo y que participará en las reuniones con voz y voto.
3. El Ministro de Industria y Energía designará a los miembros del Consejo de carácter representativo. Los que sean en representación de los Departamentos ministeriales, serán designados y cesados a propuesta de los respectivos titulares. Los que lo sean en representación de los restantes organismos o entidades, serán nombrados a propuesta de los mismos.
4. El Presidente del Consejo de Dirección nombrará entre los Vocales un Vicepresidente.
5. Los miembros del Consejo que ostenten la representación de los Departamentos ministeriales deberán tener la categoría de Director general o desempeñar cargos de análogo nivel, pudiendo delegar la asistencia a las reuniones del Consejo en un Subdirector general de su Dirección.
6. Son facultades del Consejo de Dirección:
a) Definir la política del organismo y establecer las directrices de su actuación.
b) Aprobar la gestión del Director del organismo.
c) Conocer el funcionamiento de la Oficina Española de Patentes y Marcas, por medio de los informes que periódicamente rinda el Director.
d) Aprobar el anteproyecto de presupuesto de ingresos y gastos así como la liquidación anual del mismo.
e) Aprobar la memoria anual de actividades del organismo.
f) Deliberar y adoptar acuerdos sobre los asuntos, que por su naturaleza e importancia sean sometidos a su conocimiento.
g) Cuantas funciones sean inherentes a su condición de órgano supremo del organismo.
7. Podrán asistir a las reuniones del Consejo, con voz pero sin voto, personas que, sin ser miembros del mismo, se encuentren especialmente cualificadas, cuando fueran requeridos para ello por el Presidente.
8. El Consejo de Dirección se reunirá preceptivamente una vez al año, y en cuantas ocasiones sea convocado por su Presidente. Las deliberaciones y régimen de acuerdos del Consejo se ajustarán a lo prevenido en el capítulo II del Título II de la Ley 30/1992, de 26 de noviembre, de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común.
Artículo 6. El Director.
1. El Director de la Oficina Española de Patentes y Marcas ejecuta la política y las directrices marcadas por el Consejo de Dirección y ostenta la superior jefatura de los servicios correspondientes.
2. El Director de la Oficina Española de Patentes y Marcas tiene categoría de Director general y es nombrado y separado por Real Decreto a propuesta del Ministro de Industria y Energía.
3. Son competencias del Director:
a) Ejercer la superior dirección de todos los servicios del organismo.
b) Vigilar y fiscalizar todas las dependencias a su cargo y establecer el régimen interno de las mismas.
c) Resolver los asuntos propios de la competencia de la Oficina Española de Patentes y Marcas y los recursos que se interpongan contra las resoluciones de los órganos que del mismo dependen.
d) Formular el anteproyecto de presupuesto de ingresos y gastos y autorizar y disponer los gastos propios de los servicios dentro del importe de los créditos autorizados, excepto los reservados a la competencia del Consejo de Ministros o del Ministro del Departamento, así como contraer las obligaciones y ordenar los pagos correspondientes.
e) Firmar en nombre del organismo los contratos relativos a los asuntos propios de su competencia.
f) Ejercer la dirección, gobierno y régimen disciplinario del personal dependiente del mismo con arreglo a la legislación vigente.
g) Ordenar las comisiones de servicio con derecho a dietas.
h) Dictar instrucciones y órdenes de servicio para el buen funcionamiento del organismo.
i) Comunicarse directamente para todos los asuntos del servicio con cuantos organismos y entidades españolas o extranjeras se ocupen o tengan relación con la propiedad industrial.
j) Ostentar la representación de la Oficina Española de Patentes y Marcas en el orden nacional e internacional, en defecto de asistencia del Presidente del Consejo de Dirección, y ejercer todas las demás facultades, prerrogativas y funciones que le atribuyan las disposiciones en vigor.
Artículo 7. Secretaría General.
1. La Secretaría General, con nivel orgánico de Subdirección General, es el órgano de la Oficina Española de Patentes y Marcas que tiene a su cargo los servicios de carácter general y administrativo del organismo.
2. Le corresponden, en particular, las siguientes funciones:
a) La elaboración del anteproyecto anual del presupuesto de ingresos y gastos de la Oficina.
b) La gestión y administración de los recursos humanos e interlocución con los órganos de representación del personal del organismo.
c) La gestión económica y financiera del organismo y la contratación administrativa, así como la presidencia de los órganos de contratación del organismo.
d) Dirigir la elaboración y ejecución de los planes informáticos del organismo y las funciones concernientes a las aplicaciones informáticas que en él se precisen, así como la asistencia técnica y apoyo en este campo al resto del organismo.
e) La gestión de los servicios de archivo, información y depósito, publicaciones y régimen interior.
f) Actuar como órgano de comunicación normal con los Departamentos ministeriales, organismos y entidades que tengan relación con la Oficina Española de Patentes y Marcas.
g) Gestionar los asuntos relacionados con el Colegio de Agentes de la Propiedad Industrial.
h) Atender los asuntos de carácter general no atribuidos a otras dependencias del organismo.
3. El titular de la Secretaría General suple temporalmente al Director del organismo, en caso de ausencia, vacante o enfermedad.
Artículo 8. Departamento de Patentes e Información Tecnológica.
1. El Departamento de Patentes e Información Tecnológica, con nivel orgánico de Subdirección General, tiene a su cargo las actuaciones administrativas encaminadas al reconocimiento y mantenimiento de la protección registral de las patentes de invención, topografías de productos semiconductores, modelos de utilidad y modelos y dibujos industriales y artísticos. Asimismo, le compete difundir la información tecnológica contenida en los documentos de patentes entre las empresas públicas y privadas interesadas, organismos de investigación y cualesquiera otras entidades para coadyuvar a la innovación tecnológica.
2. Le corresponde, en particular, las siguientes funciones:
a) La recepción, tramitación, estudio y propuesta de resolución de los expedientes de concesión de patentes, topografías de productos semiconductores, modelos de utilidad, modelos y dibujos industriales y artísticos, los de nulidad y caducidad, dentro del ámbito de competencia del organismo, así como los relacionados con licencias y transmisiones de derechos y demás incidencias.
b) Asegurar el cumplimiento de todas las actuaciones administrativas de apoyo, necesarias para la más adecuada consecución de las misiones que tiene atribuidas.
c) Expedir certificaciones y copias autorizadas de los documentos contenidos en los expedientes sobre modalidades propias de su competencia que se custodian en el archivo.
d) Archivar los expedientes resueltos y cuidar de su conservación.
e) Emitir informes y elaborar estadísticas sobre el funcionamiento, actividades y rendimiento de los diferentes servicios del Departamento.
f) Organizar y mantener actualizado un fondo documental de contenido tecnológico de las patentes españolas y de los principales países generadores de tecnología.
g) Facilitar a los medios interesados el acceso a la información mediante una difusión sistemática y selectiva del fondo documental de que se disponga.
h) Analizar y proponer las actuaciones oportunas que supongan una mejora de los servicios de información tecnológica, coordinándolas con las recomendaciones internacionales.
i) Cuantas actuaciones administrativas y técnicas sean precisas para un eficaz desarrollo de las funciones que tiene atribuidas.
Artículo 9. Departamento de Signos Distintivos.
1. El Departamento de Signos Distintivos, con nivel orgánico de Subdirección General, tiene a su cargo las actuaciones administrativas conducentes al reconocimiento y mantenimiento de la protección registral a las marcas nacionales e internacionales, nombres comerciales y rótulos de establecimiento.
2. Le corresponden, en particular, las siguientes funciones:
a) La recepción, tramitación, estudio y propuesta de resolución de los expedientes de concesión de cada una de las modalidades propias de su cometido, los de nulidad y caducidad, dentro del ámbito de competencia del organismo, así como los relacionados con licencias y transmisiones de derecho y demás incidencias.
b) Asegurar el cumplimiento de todas las actuaciones administrativas de apoyo necesarias para el más adecuado cumplimiento de las misiones atribuidas al Departamento.
c) Expedir certificaciones y copias autorizadas de los documentos contenidos en los expedientes correspondientes custodiados en el archivo.
d) Archivar los expedientes resueltos y atender a su conservación.
e) Emitir informes y elaborar estadísticas sobre el funcionamiento, actividades y rendimiento de los diferentes servicios.
f) Cuantas actuaciones administrativas sean precisas para un eficaz desarrollo de las actividades que tiene atribuidas.
Artículo 10. Departamento de Coordinación Jurídica y Relaciones Internacionales.
1. El Departamento de Coordinación Jurídica y Relaciones Internacionales, con nivel orgánico de Subdirección General, tiene a su cargo el apoyo jurídico al Director del organismo, así como el desarrollo de las relaciones internacionales en materia de propiedad industrial, en coordinación con el Ministerio de Asuntos Exteriores.
2. Le corresponden, en particular, las siguientes funciones:
a) Estudiar y proponer las modificaciones que sean necesarias introducir en la legislación vigente sobre propiedad industrial.
b) Preparar informes sobre los anteproyectos de ley y demás disposiciones de carácter general.
c) Elaborar los informes y dictámenes sobre cuestiones referentes a la propiedad industrial que sean solicitados por autoridades, tribunales y entidades oficiales.
d) Estudiar, clasificar y coleccionar las disposiciones legales, jurisprudencia y trabajos doctrinales relacionados con la propiedad industrial, y estar al corriente de la legislación comparada en esta materia.
e) Cuidar de la correcta aplicación, dentro de las competencias del organismo, de los convenios internacionales vigentes sobre propiedad industrial, y elevar propuestas, en su caso, sobre la participación de España en aquellos que aún no están en vigor para ella.
f) Facilitar, de acuerdo con el Ministerio de Asuntos Exteriores, las relaciones y la cooperación internacional en el campo de la propiedad industrial, manteniendo contacto con las organizaciones intergubernamentales y con cuantos organismos nacionales o internacionales, públicos o privados, se ocupan de estas materias.
g) Representar al Director del organismo, cuando sea necesario, en las reuniones internacionales a las que sea convocado o en las que deba participar la Oficina Española de Patentes y Marcas.
h) Dirigir el estudio, tramitación y propuesta de resolución de los recursos que se interpongan contra cualquier resolución del organismo, de acuerdo con las disposiciones legales aplicables. Igualmente, se ocupa de las relaciones con los tribunales.
i) Preparar las reuniones y conferencias internacionales que se celebren en España en materia de propiedad industrial.
j) Preparar la memoria anual de actividades que ha de elevarse a la consideración del Consejo de Dirección.
Artículo 11. Patrimonio y medios económicos.
1. La Oficina Española de Patentes y Marcas contará para el cumplimiento de sus fines, con su patrimonio propio, así como con los bienes y derechos que se le adscriban por la Administración General del Estado.
2. Los bienes y medios económicos de la Oficina Española de Patentes y Marcas serán los siguientes:
a) Los créditos que anualmente se consignen a su favor en los Presupuestos Generales del Estado.
b) Los bienes y derechos que constituyan su patrimonio propio y los productos, rentas o dividendos que pueden derivarse del mismo.
c) Los ingresos provenientes de las tasas que le corresponda percibir, así como las prestaciones patrimoniales y precios públicos que ingrese por la venta de bienes y prestación de sus servicios.
d) Los ingresos procedentes de la Organización Mundial de la Propiedad Intelectual (OMPI), de la Oficina Europea de Patentes (OEP) y de la Oficina de Armonización del Mercado Interior (OAMI), en virtud del derecho comunitario aplicable, los Convenios internacionales suscritos, así como cualesquiera otros que pudieran producirse en virtud de los Tratados o Convenios internacionales que el Gobierno español pudiera celebrar.
