241.3Verordnung über das Klagerecht des Bundes im Rahmen des Bundesgesetzes gegen den unlauteren Wettbewerb

vom 17. Februar 1993 (Stand am 1. Februar 2000)

Der Schweizerische Bundesrat, gestützt auf Artikel 10 Absatz 2 Buchstabe c des Bundesgesetzes gegen den unlaute­ ren Wettbewerb (UWG)1, verordnet:

Art. 1 Klagerecht des Bundes 1 In Zivil- und Strafverfahren auf der Grundlage von Artikel 10 Absatz 2 Buch­ stabe c UWG wird der Bund durch das Staatssekretariat für Wirtschaft (SECO)2 ver­ treten. 2 In besonderen Fällen kann der Bund im Einvernehmen mit dem SECO durch eine andere Amtsstelle vertreten werden.

Art. 2 Inkrafttreten Diese Verordnung tritt am 1. März 1993 in Kraft.

AS 1993 1053 1 SR 241 2 Ausdruck gemäss Art. 22 Abs. 1 Ziff. 2 der V vom 17. Nov. 1999, in Kraft seit 1. Juli

1999 (AS 2000 187). Diese Änd. ist im ganzen Erlass berücksichtigt.

Le Conseil fédéral suisse,

vu l’article 10, 2e alinéa, lettre c, de la loi contre la concurrence déloyale 1 (LCD),

arrête :

Droit de la Confédération d’intenter une action

1. — 1 Le Secrétariat d’État à l’économie (seco) 2 représente la Confédération dans des procédures civiles ou pénales fondées sur l’article 10, 2e alinéa, lettre c, LCD.

2 Dans des cas spéciaux, la Confédération peut, d’entente avec le seco, être représentée par un autre service.

Entrée en vigueur

2. La présente ordonnance entre en vigueur le 1er mars 1993.

241.3Ordinanza concernente il diritto di azione della Confederazione nel quadro della legge contro la concorrenza sleale

del 17 febbraio 1993 (Stato 1° febbraio 2000)

Il Consiglio federale svizzero, visto l’articolo 10 capoverso 2 lettera c della legge contro la concorrenza sleale1 (LCSl), ordina:

Art. 1 Diritto d’azione della Confederazione 1 Il Segretariato di Stato dell’economia (seco)2 rappresenta la Confederazione nei procedimenti civili o penali fondati sull’articolo 10 capoverso 2 lettera c LCSl. 2 In casi speciali la Confederazione può, d’intesa con il seco, farsi rappresentare da un altro servizio.

Art. 2 Entrata in vigore La presente ordinanza entra in vigore il 1° marzo 1993.
