'The purpose of the Government Order is to bestow on independent broadcasting services provided for in the Radio and Television Act of 1988 copyright protection similar to that given to Radio Telefis Eireann under the Copyright Act, 1963'.

Copyright (Extended Application) Order, 1991

(No. 101 of April 23, 1991)

1. This Order may be cited as the Copyright (Extended Application) Order, 1991.
2. In this Order-
"the Act of 1988" means the Radio and Television Act, 1988 (No. 20 of 1988);
"the Commission" means the Independent Radio and Television Commission;
"sound broadcasting contract", "sound broadcasting contractor", "television programme service contract" and "television programme service contractor" have the meanings assigned to them, respectively, by section 4(2) of the Act of 1988.
3. The provisions of the Copyright Act, 1963, in so far as they relate to television broadcasts and sound broadcasts made by Radio Telefís Eireann shall apply to such broadcasts and the distribution of audio-visual programme material of any description by the means specified in section 17 of the Act of 1988 when made, or distributed by:

(a) a sound broadcasting contractor who, pursuant to section 4(2)(a) of the Act of 1988, has entered into a sound broadcasting contract with the Commission, and

(b) a television programme service contractor who, pursuant to section 4(2)(b) of the Act of 1988 has entered into a contract with the Commission, whether or not he has also entered into a contract pursuant to section 6(1) of the Broadcasting Act, 1990 (No. 24 of 1990),

for the purposes of such contracts, and the said provisions in so far as they relate to the broadcasts and the distribution of audio-visual programme material shall be construed as though any reference to Radio Telefís Eireann therein contained were a reference to such a sound broadcasting contractor and television programme service contractor.

Ordonnance de 1991 sur le droit d’auteur portant extension du champ d’application de la loi*

(N° 101 du 23 avril 1991)

1. La présente ordonnance peut être citée comme l’ordonnance de 1991 sur le droit d’auteur portant extension du champ d’application de la loi.

2. Dans la présente ordonnance :

“loi de 1988” s’entend de la loi de 1988 sur la radio et la télévision (n° 20 de 1988);

“commission” s’entend de la commission indépendante pour la radio et la télévision;

“contrat de radiodiffusion sonore”, “fournisseur de programmes de radiodiffusion sonore”, “contrat de fourniture de programmes de télévision” et “fournisseur de programmes de télévision” ont le sens défini à l’article 4.2) de la loi de 1988.

3. Les dispositions de la loi de 1963 sur le droit d’auteur, dans la mesure où elles visent les émissions de télévision et les émissions de radiodiffusion sonore de Radio Telefís Eireann, s’appliquent auxdites émissions et à la distribution de programmes audiovisuels de toute nature par les moyens précisés à l’article 17 de la loi de 1988, lorsque ces émissions ou cette distribution sont assurées par :

a) un fournisseur de programmes de radiodiffusion sonore qui, conformément à l’article 4.2)a) de la loi de 1988, a passé un contrat de radiodiffusion sonore avec la commission,

b) un fournisseur de programmes de télévision qui, conformément à l’article 4.2)b) de la loi de 1988, a passé un contrat avec la commission, qu’il ait ou non également passé un contrat conformément à l’article 6.1) de la loi de 1990 sur la radiodiffusion (n° 24 de 1990),

aux fins des contrats ainsi conclus; dans la mesure où elles visent les émissions de radiodiffusion et la distribution de programmes audiovisuels, ces dispositions doivent être interprétées comme si toute mention qui y est faite de Radio Telefís Eireann renvoyait au fournisseur de programmes de radiodiffusion sonore ou au fournisseur de programmes de télévision en question.
