The Parliament ofthe Republic ofMotdova shall ctdopt the present organic law:
Art. I - Article lO of the Law No. 46I-XUl of May 18, 1995 on Patents for

Inventions (republished in the Official Bulletin of the Repu.blic of Moldova,

pentru modificarea şi completarea unor acte legislative

Parlamentul adoptă prezenta lege organică.

Art.I. – Articolul 10 din Legea nr. 461XIII din 18 mai 1995 privind brevetele de invenŃie (republicată în Monitorul Oficial al Republicii Moldova, 2003, nr.126131, art.505) se modifică şi se completează după cum urmează:

la alineatul (8), textul "Documentele cererii se depun în limba de stat" se înlocuieşte cu textul "Persoanele juridice depun documentele cererii în limba moldovenească", iar sintagma „limba de stat” se înlocuieşte cu sintagma „limba moldovenească”;

după alineatul (8) se introduce un alineat nou, care devine alineatul (9), cu următorul cuprins:

"(9) Persoanele fizice depun documentele cererii în limba moldovenească sau în limba rusă. Se permite depunerea documentelor cererii, cu excepŃia cererii propriuzise, redactate în una din limbile de circulaŃie internaŃională: engleză, franceză, germană. În acest caz, traducerea documentelor cererii în limba moldovenească sau în limba rusă se depune la AgenŃie în termen de 2 luni de la data depozitului naŃional reglementar, cu respectarea acestei date. Dacă solicitantul nu depune traducerea documentelor în limba moldovenească sau în limba rusă în termenul indicat, cererea se consideră nedepusă."

Art.II. – La articolul 8 alineatul (7) din Legea nr.588XIII din 22 septembrie 1995 privind mărcile şi denumirile de origine a produselor (republicată în Monitorul Oficial al Republicii Moldova, 2001, nr.150151, art.1187), cu modificările ulterioare:

sintagma „limba de stat” se înlocuieşte cu sintagma „limba moldovenească”;

alineatul se completează în final cu propoziŃia: "Persoanele fizice care au depus documentele cererii în limba rusă nu sînt obligate să prezinte traducerea acestora în limba moldovenească."

Art.III. – Articolul 17 alineatul (5) din Legea nr.915XIII din 11 iulie 1996 privind protecŃia soiurilor de plante (Monitorul Oficial al Republicii Moldova, 1996, nr.77, art.728), cu modificările ulterioare, va avea următorul

cuprins:

"(5) Cererea propriuzisă de brevet se redactează în limba moldovenească pe un formular tip. Celelalte documente ale cererii se depun în limba moldovenească sau în altă limbă. În ultimul caz, traducerea documentelor cererii în limba moldovenească se depune la AgenŃie în termen de 2 luni de la data depozitului naŃional reglementar. Persoanele fizice care au depus documentele cererii în limba rusă nu sînt obligate să prezinte traducerea acestora în limba moldovenească."

Art.IV. – Articolul 11 din Legea nr.991XIII din 15 octombrie 1996

alineatul (2) va avea următorul cuprins:

"(2) Cererea propriuzisă se redactează în limba moldovenească pe un formular tip."

alineatul (7):

sintagma „limba de stat” se înlocuieşte cu sintagma „limba moldovenească”;

alineatul se completează în final cu propoziŃia: "Persoanele fizice care au depus documentele anexate cererii în limba rusă nu sînt obligate să prezinte traducerea acestora în limba moldovenească.”

Art.V. – Articolul 3 din Legea nr.655XIV din 29 octombrie 1999 privind protecŃia topografiilor circuitelor integrate (Monitorul Oficial al Republicii Moldova, 2000, nr.14, art.4 ) se modifică şi se completează după cum urmează:

la alineatul (1), textul ", ale cărui documente se depun tipărite în limba de stat" se exclude;

la alineatul (2) punctul 1), după cuvîntul „cerere” se introduce textul ", redactată pe un formular tip";

alineatul (3) va avea următorul cuprins:

"(3) Cererea propriuzisă se redactează în limba moldovenească pe un formular tip. Celelalte documente ale cererii se depun în limba moldovenească sau în altă limbă. În ultimul caz, traducerea documentelor cererii în limba moldovenească se depune la AgenŃie în termen de 2 luni de la data depozitului

naŃional reglementar. Persoanele fizice care au depus documentele cererii în limba rusă nu sînt obligate să prezinte traducerea acestora în limba moldovenească."

Art.VI. – Articolul 9 alineatul (10) din Legea nr.138XV din 10 mai 2001 cu privire la activitatea de raŃionalizare (Monitorul Oficial al Republicii Moldova, 2001, nr.8183, art.608 ) va avea următorul cuprins:

"(10) Cererea şi materialele anexate la aceasta se redactează în limba moldovenească sau în limba rusă."

ЗАКОН

о внесении изменений и дополнений в некоторые законодательные акты

Парламент принимает настоящий органический закон.

Ст.I. – В статью 10 Закона о патентах на изобретение № 461XIII от 18 мая 1995 года (повторное опубликование: Официальный монитор Республики Молдова, 2003 г., № 126 131, ст.505) внести следующие изменения и дополнение:

в части (8) слова "Документы заявки подаются на государственном языке," заменить словами "Юридические лица подают документы заявки на молдавском языке,", а слова "государственный язык" – словами "молдавский язык";

дополнить статью новой частью (9) следующего содержания:

"(9) Физические лица подают документы заявки на молдавском или русском языке. Разрешается подача документов заявки, за исключением заявления, на одном из языков международного общения – английском, французском, немецком. В этом случае перевод документов заявки на молдавский или русский язык представляется в Агентство в двухмесячный срок с даты подачи заявки, с соблюдением этой даты. Если в указанный срок заявитель не представит перевод документов на молдавский или русский язык, заявка считается неподанной.";

части (9) и (10) считать соответственно частями (10) и (11).

Ст.II. – В части (7) статьи 8 Закона о товарных знаках и наименованиях мест происхождения товаров № 588XIII от 22 сентября 1995 года (повторное опубликование: Официальный монитор Республики Молдова, 2001 г., № 150151, ст.1187), с последующими изменениями:

слова "государственном", "государственный" заменить словом "молдавский" в соответствующем падеже;

дополнить часть предложением: "Физические лица, подавшие документы заявки на русском языке, не обязаны представлять их перевод на молдавский язык.".

Ст.III. – Часть (5) статьи 17 Закона об охране сортов растений № 915XIII от 11 июля 1996 года (Официальный монитор Республики Молдова, 1996 г., № 77, ст.728), с последующими изменениями, изложить в следующей редакции:

"(5) Заявление на патент оформляется на типовом бланке на молдавском языке. Остальные документы заявки подаются на молдавском или ином языке. В последнем случае перевод документов заявки на молдавский язык представляется в Агентство в двухмесячный срок с даты правильно оформленной национальной заявки. Физические лица, подавшие документы заявки на русском языке, не обязаны представлять их перевод на молдавский язык.".

Ст.IV. – В статью 11 Закона об охране промышленных рисунков и моделей № 991XIII от 15 октября 1996 года (Официальный монитор Республики Молдова, 1997 г., № 1011, ст.119), с последующими изменениями, внести следующие изменения и дополнение:

часть (2) изложить в следующей редакции:

"(2) Собственно заявка оформляется на типовом бланке на молдавском языке.";

в части (7):

слова "государственном" и "государственный язык" заменить соответственно словами "молдавском" и "молдавский язык";

дополнить часть предложением: "Физические лица, подавшие прилагаемые к заявке документы на русском языке, не обязаны представлять их перевод на молдавский язык.".

Ст.V. – В статью 3 Закона об охране топографий интегральных схем № 655XIV от 29 октября 1999 года (Официальный монитор Республики Молдова, 2000 г., № 14, ст.4) внести следующие изменения и дополнение:

в части (1) слова ", документы которой подаются в печатном виде на государственном языке" исключить;

пункт 1) части (2) после слов "заявления о регистрации," дополнить словами "оформленного на типовом бланке,";

часть (3) изложить в следующей редакции:

"(3) Заявление оформляется на типовом бланке на молдавском языке. Остальные документы заявки подаются на молдавском или ином языке. В последнем случае перевод документов заявки на молдавский язык подается в Агентство в двухмесячный срок с даты подачи правильно оформленной национальной заявки. Физические лица, подавшие документы заявки на русском языке, не обязаны представлять их перевод на молдавский язык.".

Ст.VI. – Часть (10) статьи 9 Закона о рационализаторской деятельности № 138XV от 10 мая 2001 года (Официальный монитор Республики Молдова, 2001 г., № 8183, ст.608) изложить в следующей редакции:

"(10) Заявление и прилагаемые к нему материалы оформляются на молдавском или русском языке.".
